Wer nicht nur vor\u00fcbergehend ins Ausland will, braucht den Stempel von Vater Staat. Vater Staat ist in diesem Falle das Verteidigungsministerium, kurz das BMVg. Dieses wird \u00f6rtlich von den sog. Genau hier kann \u00a7 3 Abs. 2 WPflG praktische Folgen haben:<\/p>\n<ul>\n<li><strong>Arbeitnehmer im Secondment<\/strong> \u2013 Mitarbeiter werden f\u00fcr mehrere Monate in ausl\u00e4ndische Konzerngesellschaften, Niederlassungen oder Teams entsandt.<\/li>\n<li><strong>Projektmitarbeiter und Spezialisten im Auslandseinsatz<\/strong> \u2013 Etwa Berater, Ingenieure, IT-Spezialisten, Juristen, Compliance-Verantwortliche oder Interim-Manager.<\/li>\n<li><strong>Unternehmer mit typischerweise l\u00e4ngeren Auslandsaufenthalten<\/strong> \u2013 Zum Beispiel wegen Investoren, Produktionsstandorten, Lieferketten, Verhandlungen oder operativer Leitung im Ausland.<\/li>\n<li><strong>Gesch\u00e4ftsf\u00fchrer und Organtr\u00e4ger<\/strong> \u2013 Gerade in kleineren und mittleren Unternehmen h\u00e4ngt viel an einzelnen Schl\u00fcsselpersonen mit internationaler Pr\u00e4senz.<\/li>\n<li><strong>Gr\u00fcnder, Start-up-F\u00fchrungskr\u00e4fte und digitale Unternehmer<\/strong> \u2013 Insbesondere bei Wohnsitz- oder Lebensmittelpunktverlagerungen nach Dubai, Zypern oder Spanien.<\/li>\n<li><strong>Influencer, Content Creator und ortsunabh\u00e4ngige digitale Gesch\u00e4ftsmodelle<\/strong> \u2013 Wer l\u00e4ngere Zeit aus dem Ausland arbeitet, produziert oder seine Struktur dorthin verlagert, sollte das Thema nicht ignorieren.<\/li>\n<li><strong>Selbst\u00e4ndige und Freiberufler mit internationalem Gesch\u00e4ftsmodell<\/strong> \u2013 Etwa Berater, Agenturinhaber, Entwickler, Coaches, E-Commerce-Unternehmer oder K\u00fcnstler.<\/li>\n<li><strong>Studierende und Nachwuchskr\u00e4fte<\/strong> \u2013 Etwa bei ERASMUS, Auslandssemestern oder l\u00e4nger angelegten Ausbildungsaufenthalten.<\/li>\n<li><strong>Remote Worker und Digital Nomads<\/strong> \u2013 Wer monatelang aus dem Ausland arbeitet, bewegt sich schnell in einer rechtlichen Grauzone.<\/li>\n<\/ul>\n<p>Der Punkt ist simpel: \u00a7 3 Abs. 2 WPflG ist kein exotisches Wehrrechtsdetail mehr. Die Norm kann zu einem echten Mobilit\u00e4ts-, Planungs- und Compliance-Thema werden \u2013 f\u00fcr Arbeitnehmer ebenso wie f\u00fcr Unternehmen, Gr\u00fcnder und international t\u00e4tige Einzelpersonen.<\/p>\n<div>Hinzu kommt: In der Praxis bleibt es selten beim Wehrpflichtgesetz allein. Je nach Konstellation stellen sich auch Fragen des Passrechts, des Melderechts, des Berufsrechts, des Strafrechts und anderer verwaltungsrechtlicher Vorschriften.<\/div>\n<\/div>","detail_call_to_action_enabled.Value":"false","detail_slider_enabled.Value":"false","detail_heading.Content":"Rechtlicher Hintergrund","detail_text.Content":"<div>\n<p><span>Der Staat hat es Deutschen, die ihren Lebensmittelpunkt au\u00dferhalb der Bundesrepublik suchen, schon traditionell recht schwer gemacht. Zu denken ist etwa an die sog. Wegzugsbesteuerung, wo Deutsche, die ihren Erstwohnsitz ins Ausland, einschlie\u00dflich dem EU-Ausland, verlegten, ordentlich zur Kasse gebeten werden. W\u00e4hrend diese staatlichen Eingriffe bis dato schwerpunktm\u00e4\u00dfig von fiskalischen Interessen motiviert gesessen zu sein scheinen, kommt mit der Reaktivierung des Wehrpflichtgesetzes (kurz: WPflG) eine weitere H\u00fcrde f\u00fcr Auslandswillige hinzu. Die Rede ist von \u00a7 3 Abs. 2 WPflG. Dieser Paragraph ist - entgegen einiger Falschmeldungen in der Presse -\u00a0<\/span><span>nicht<\/span><span> neu. Er ist lediglich durch die Neufassung des \u00a7 2 Abs. 3 WPflG auch auf den Normalfall erweitert worden, nachdem er zuvor nur im Falle des Spannungs- oder Verteidigungsfall (= Angriff auf die BRD, Nato\/EU) zur Anwendung kommen sollte. Da kein solcher Fall je seit dem 2. Weltkrieg ausgerufen wurde, fand diese Regelung in der Lebenswirklichkeit nie Anwendung. Das ist nun anders. Damit wirkt eine wehrrechtliche Norm erstmals in den normalen Lebens- und Wirtschaftsalltag hinein. \u00a7 3 Abs. 2 Satz 1 WPflG sagt:<\/span><\/p>\n<p><em>Wehrpflichtgesetz (WPflG)<\/em><\/p>\n<p><em>\u00a7 3 Inhalt und Dauer der Wehrpflicht<\/em><\/p>\n<p><em>(2) M\u00e4nnliche Personen haben nach Vollendung des 17. Lebensjahres eine Genehmigung des zust\u00e4ndigen Karrierecenters der Bundeswehr einzuholen, wenn sie die Bundesrepublik Deutschland l\u00e4nger als drei Monate verlassen wollen, ohne dass die Voraussetzungen des \u00a7 1 Absatz 2 bereits vorliegen.\u00a0<\/em><\/p>\n<\/div>","detail_cta_lead_in.Content":"","detail_cta.Attribute":"Kontakt","detail_cta.Value":"\/kontakt","detail_heading_opt1.Content":"Betroffener Personenkreis","detail_text_opt1.Content":"<p>Nach aktueller Rechtslage muss mit Blick auf den klaren Wortlaut und die dahinterstehende Intention des Gesetzgebers klar davon ausgegangen werden, dass diese Melde- und Genehmigungspflicht f\u00fcr alle deutschen Staatsangeh\u00f6rigen gilt, die das 17. Lebensjahr vollendet haben und noch nicht 45 Jahre alt sind.<\/p>\n<p>Gemeint sind vor allem die Jahrg\u00e4nge 1994 bis 2007, die wegen der Aussetzung des Wehrpflichtgesetzes gar nicht erst gemustert worden sind.
