Die Vorinstanz war f\u00e4lschlicherweise davon ausgegangen, dass der Kl\u00e4ger berechtigterweise auf die Vertraulichkeit seiner \u00c4u\u00dferungen vertrauen konnte. Laut Bundesarbeitsgericht besteht eine solche Vertraulichkeitserwartung nur, wenn die Mitglieder der Chatgruppe einen besonderen Schutz ihrer Kommunikation beanspruchen k\u00f6nnen, abh\u00e4ngig vom Inhalt der Nachrichten und der Struktur der Chatgruppe. Bei Nachrichten, die beleidigende Bemerkungen \u00fcber Betriebsangeh\u00f6rige enthalten, muss der Arbeitnehmer darlegen, warum er glaubte, dass diese Informationen nicht an Dritte weitergegeben werden w\u00fcrden.<\/span><\/p>\n<p><span>Das Bundesarbeitsgericht wies die Sache an das Landesarbeitsgericht zur\u00fcck, um dem Arbeitnehmer die M\u00f6glichkeit zu geben, zu erkl\u00e4ren, warum er aufgrund der Gr\u00f6\u00dfe und Zusammensetzung der Chatgruppe sowie der unterschiedlichen Beteiligung der Gruppenmitglieder im Chat und der Nutzung eines schnelllebigen Chats eine Erwartung auf Vertraulichkeit hatte.<\/span><\/p>\n<\/div>","detail_call_to_action_enabled.Value":"false","detail_slider_enabled.Value":"false","detail_heading.Content":"Der Fall","detail_text.Content":"<div>\n<p><span>Das Urteil des Bundesarbeitsgerichts (BAG) beruht auf folgendem Sachverhalt: Ein langj\u00e4hriger Mitarbeiter war Mitglied einer privaten WhatsApp-Chatgruppe mit Kollegen, die teilweise langj\u00e4hrige Freundschaften und famili\u00e4re Bindungen pflegten. In dieser Gruppe wurden neben privaten Themen auch beleidigende und menschenverachtende Kommentare \u00fcber Vorgesetzte und Kollegen ausgetauscht. Der Mitarbeiter \u00e4u\u00dferte sich dabei unter anderem mit Aussagen wie \u201eDer Pole ist der Schlimmste\u201c, \u201eAlle aufkn\u00fcpfen den Polen zuerst\u201c, \u201eneues Opfer f\u00fcr den Grabscher von Bosporus Frau A.\u201c, \u201ezionistische Herrscherlobby\u201c, \u201eUnd die Neeger kommen\u201c und \u201eder soll seine Fresse halten, sonst l\u00e4uft bald \u201aspiel mir das Lied vom Tod\u2018 noch mal im Kino in D.\u201c<\/span><\/p>\n<p><span>Nachdem der Arbeitgeber von diesen \u00c4u\u00dferungen Kenntnis erhalten hatte, k\u00fcndigte er das Arbeitsverh\u00e4ltnis au\u00dferordentlich und fristlos. Die Gerichte befanden, dass die \u00c4u\u00dferungen in der WhatsApp-Chatgruppe in einem Umfeld get\u00e4tigt wurden, in dem der Arbeitnehmer auf Vertraulichkeit vertrauen durfte. Arbeitnehmer sollten sich dessen bewusst sein, dass selbst in privaten Gruppen Inhalte an Dritte, einschlie\u00dflich ihres Arbeitgebers, weitergegeben werden k\u00f6nnen. Die Annahme, dass Vertraulichkeit vor arbeitsrechtlichen Folgen wie einer K\u00fcndigung sch\u00fctzt, ist keineswegs selbstverst\u00e4ndlich.<\/span><\/p>\n<p><span>F\u00fcr Arbeitgeber bedeutet die Entscheidung des Bundesarbeitsgerichts eine geringere H\u00fcrde beim Vorgehen gegen schwerwiegende, insbesondere beleidigende und menschenverachtende \u00c4u\u00dferungen innerhalb der Belegschaft. Diese Klarstellung ist bedeutsam, da das BAG in seinem Urteil vom 10. Dezember 2009 (2 AZR 534\/08) noch feststellte, dass Arbeitnehmer regelm\u00e4\u00dfig darauf vertrauen d\u00fcrfen, dass ehrverletzende \u00c4u\u00dferungen \u00fcber Vorgesetzte und Kollegen nicht nach au\u00dfen getragen werden.<\/span><\/p>\n<p><span>Die aktuelle Entscheidung hebt die Bedeutung des Inhalts der \u00c4u\u00dferungen hervor. Bei besonders schwerwiegenden Aussagen kann ein Arbeitnehmer nicht ohne weiteres auf Vertraulichkeit vertrauen. In einer Zeit, in der die Grenzen zwischen Beruflichem und Privatem zunehmend verschwimmen, ist es unerl\u00e4sslich, sich der m\u00f6glichen Konsequenzen bewusst zu sein.
