AI Officer as a Service - Your compliance solution for the new Art. 4 AI Regulation requirements

As of February 2, 2025, all companies working with AI are subject to a so-called AI competency requirement. This is stipulated in Article 4 of the AI Regulation, which, similar to the GDPR, is directly applicable in all member states. They must be able to demonstrate this AI competency requirement, at the latest upon request from the supervisory authorities, from August 2, 2025. This is the point in time at which the sanctions pursuant to Articles 99 et seq. of the AI Regulation will come into effect. Companies, regardless of size, will then be required to demonstrate AI competency. The safest way to fulfill this requirement of demonstrating AI competency is to appoint an external AI officer, as is already systematically known from the appointment of a data protection officer.

The focus of my work as an external AI officer is to ensure that all relevant stakeholders have sufficient knowledge and skills in dealing with AI systems and that they are protected from fines and reputational damage.

How is this implemented?

1. AI Troubleshooting

Together we will conduct an AI inventory by looking at which AI systems are in use in your company, both in external communication with customers or service providers and in internal communication among employees (e.g. chatbots for research purposes). 

The results are grouped according to the risk-based approach pursued by the AI Regulation into unacceptable AI systems, which can play a role particularly in the HR area, high-risk AI systems, AI tools with acceptable risk and finally those with minimal risk.

2. Compliance review

  • Ensuring compliance with legal requirements such as the EU AI Act and the GDPR.
  • Testing for transparency, robustness and security of the systems.

3. Documentation

Review and update documentation related to AI systems, including:

  • Origin and quality of training data.
  • Algorithmic transparency.
  • Decision-making processes and their effects.

4. Conducting audits and risk assessments

  • Analysis of potential risks such as discrimination or security gaps.
  • Assessment of ethical challenges and potential negative impacts on employees or customers.

5. Consulting and training

  • Advising management and specialist departments on legal, technical and ethical requirements.
  • Training employees in the use of AI systems and raising awareness of regulatory requirements.

6. Collaboration with internal and external stakeholders

  • Close coordination with data protection officers, IT security officers and works councils.
  • Communication with regulatory authorities in the event of audits or inquiries.

7. Optimization of processes

  • Suggestions for improving AI systems in terms of efficiency, fairness and compliance.
  • Support in the integration of new AI technologies while taking regulatory requirements into account
