When the going gets tough, the tough gets going
Litigation is an issue if and to the extent that no harmonious agreement can be reached and both parties believe that they are fully or partially in the right. Then it's time to get tough, roll up your sleeves and do what many legal professionals studied law to do: determine the burden of proof, argue and fight for the client. This is where another advantage of hiring an external lawyer becomes apparent: while permanent company lawyers are not authorized to represent the employer in civil cases before the regional courts for professional reasons, an external lawyer has these legal requirements (so-called postulation capacity). Geißler-Legal therefore brings the ability coupled with the background knowledge as a former in-house counsel.
Legal dispute does not necessarily mean a court decision
If a legal dispute arises, I am available to provide you with comprehensive litigation support to strengthen your position in court and achieve your goals. Not least because it is often the courts themselves that, after the first exchange of written pleadings between the parties, let it be known that, as is so often the case, "the truth lies in the middle", a compromise, the so-called settlement, is often reached. Although the settlement has its appeal with a view to future legal certainty and legal clarity, you do not have to agree to it. Especially not if the evidence appears to be better for you than for the other side. What is needed is patience, idealism and trust in the lawyer's procedural work.
